2. Orders & Contract Formation

Placing an Order: When you place an order on our website, you will receive an automated email acknowledging receipt of your purchase. This email does not constitute legal acceptance of your order.
Contract Acceptance: A binding contract between you and Cocoa Nofel is formed when we dispatch your products and send you a dispatch confirmation email.
Order Rejection: We reserve the right to decline or cancel an order for any reason (e.g., product out of stock, pricing errors, or failure to obtain payment authorisation).

3. Pricing & Payment

Prices: All prices listed on our website are in pounds sterling (£ GBP) and include VAT (where applicable). Shipping fees are calculated and displayed at checkout prior to final payment.
Price Changes: We reserve the right to adjust prices at any time without notice, but changes will not affect orders that have already been confirmed.
Payment Processing: We accept payment via major credit/debit cards, Apple Pay, PayPal, and Stripe. Payment must be made in full at the time of placing your order.

4. Delivery & Shipping

Dispatch Times: Our artisan hot chocolate mixes and products are prepared in small batches. We aim to dispatch orders within 2 to 4 working days, though peak seasonal times may take slightly longer.
Delivery Services: Deliveries are handled by trusted third-party couriers (such as Royal Mail). Delivery timescales provided at checkout are estimates and are not guaranteed.
Warm Weather Clause: Because chocolate products are heat-sensitive, during periods of extreme warm weather, we reserve the right to briefly delay dispatching your package to prevent melting in transit. We will notify you if this occurs.
Customer Address Errors: Please ensure your shipping address is accurate. We cannot be held liable for packages delayed, misdelivered, or lost due to incorrect details provided at checkout.

5. Cancellations, Returns & Refunds

Standard Cancellation Right (UK Consumer Contracts Regulations)

Under UK law, consumers generally have a 14-day statutory right to cancel an online order.
Under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, bespoke or personalised goods (items made to the consumer's specifications or clearly personalised) are explicitly exempt from the standard 14-day cancellation and return rights.

Food & Hygiene Exemption

Please Note: Under Regulation 28(1)(b) & (c) of the Consumer Contracts Regulations 2013, perishable food items and sealed goods that have been unsealed after delivery are exempt from the standard 14-day right of return for hygiene and health protection reasons.

Non-Returnable Items: Due to safety regulations, opened sachets, custom-blended favours, or unsealed food boxes cannot be returned or refunded unless faulty.
Unopened Non-Food Items / Unshipped Orders: You may cancel your order for a full refund at any time before it has been dispatched by emailing us immediately at contact@cocoanofel.com.

Damaged, Faulty, or Incorrect Items

If your order arrives damaged, defective, or incorrect, we will happily replace or refund it:

Contact us within 48 hours of receiving your package.
Provide your order number and photo evidence of the damage/issue.
If confirmed faulty, we will issue a full refund (including standard delivery charges) or dispatch a replacement at no extra charge.

6. Allergens & Product Information

Food Safety: Full ingredient listings and allergen information for every blend are clearly displayed on product packaging and listed on our individual product pages.
Allergen Warnings: Our products are prepared in a kitchen environment that handles major allergens including milk, oats, barley, nuts, peanuts, and soya. Customers with severe food allergies must review ingredient lists carefully prior to consumption.

7. Intellectual Property

All content on this website - including brand logos, product names ("The First Edition", "Wuthering Heights", "Mr. Darcy", etc.), written text, imagery, and label design layouts - is the intellectual property of Cocoa Nofel and is protected by UK intellectual property law.

8. Limitation of Liability

To the fullest extent permitted by UK law, Cocoa Nofel shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website or products. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any statutory rights that cannot be excluded under UK consumer law.
